Robert Kraft lawyers call video 'pornography' in attempt to suppress evidence

  • The attorney representing New England Patriots owner Robert Kraft in his Florida prostitution case filed a motion asking a judge to suppress surveillance video of Kraft inside a day spa

New England Patriots owner Robert Kraft celebrates with the Vince Lombardi Trophy after winning Super Bowl LIII. "There's no interest in actually seeing the video unless you have a prurient interest in seeing the video". If the footage can't be used in court, Kraft will likely have an easier path to freedom. But Kraft's team says it's "basically pornography".

Jupiter police said Kraft, who is pleading not guilty to the charges against him, visited Orchids of Asia Day Spa on January 19 and 20.

Kraft was charged with two counts of solicitation as part of a multicounty investigation that also resulted in about 300 male customers being charged, 10 massage parlors being closed and their owners charged with felony prostitution. Both times, surveillance video captured a woman performing a sex act on Kraft and showed him paying in cash, according to police. The alleged crime occurred at the Orchids of Asia Day Spa in Jupiter, Florida, just days before the AFC Championship game.

"We've vetted this case, we've done our due diligence, there is no human trafficking that arises out of this investigation".

Attorneys for Kraft filed a second amended motion Wednesday, requesting that a judge issue a protective order preventing the video's public release.

The soliciting prostitution charge will be dismissed after each of the five men pay a $5,000 fine, complete 100 hours of community service and admit knowledge of the illicit activity. Burck also argued the release of the videos would hurt Kraft's right to a fair trial.

The media coalition's attorneys argued the public has a right to see the video and that Kraft quote "does not enjoy- as a criminal defendant in a criminal case- the right to privacy".
