EC Bars Adityanath From Campaigning for 72 Hours, Mayawati for 48 Hours

The commission's orders came hours after the Supreme Court gave the poll panel time till tomorrow to report on the action taken against the two prominent politicians for their controversial speeches.

The EC barred Yogi Adityanath from campaigning for 72 hours and BSP chief Mayawati for 48 hours starting tomorrow morning for violating Model Code of Conduct.

While the BSP leader had urged the Muslim community to vote only for the SP-BSP-RLD alliance candidates, the Chief Minister had said if the Congress, the Samajwadi Party and the BSP had faith in Ali, "we have faith in Bajrangbali".

In 2014, the Commission took action against BJP chief Amit Shah and Samajwadi Party's Azam Khan for hate speech.

Mr Yogi was served the notice for his remarks Ali and Bajrang Bali while addressing a rally in Meerut.

In a separate order, it also barred Gandhi from holding any public meetings, processions, rallies, road shows and interviews, public utterance in media related to the elections for 48 hours. A bench headed by Chief Justice of India (CJI) Ranjan Gogoi said the ECI is duty-bound to take action against those who make hateful remarks and violate the model code of conduct.

The EC may have to explain on Tuesday how it made a decision to take action when Mayawati and Adityanath had not filed reply to the notices.


On Thursday, the EC had issued show cause notices to Mayawati and UP CM Yogi Adityanath over their speeches violating Model Code of Conduct (MCC). While Ali is revered by Muslims as Prophet Mohammad's successor, Bajrang Bali is another name for Lord Hanuman.

The counsel appearing for the poll panel said that it has already issued notices against the two politicians.

In its order on Adityanath, the poll panel observed that being the chief minister of a state, he has an "added responsibility to not only uphold the basic tenets, including secularism, of the Constitution of India, but also to display the same in his public appearances".

The order said, the EC is convinced that Adityanath made a "highly provocative" speech which had the "tone and tenor" to aggravate existing differences or create mutual hatred between religious communities.

Earlier today, the Supreme Court - which was hearing an appeal seeking action against political parties using use religion and caste to seek votes - was extremely upset when the Election Commission's representative said, "We don't have any powers".

Since Khan had not given a similar assurance, the ban on him had continued.
