  • Jussie Smollett set to appear in court as attorney for brothers says actor betrayed their trust

One still camera and one video camera will be allowed when the "Empire" star appears in court Thursday, Chief Cook County Criminal Courts Judge LeRoy Martin Jr. decided, according to the Chicago Sun Times.

Schmidt represents Ola and Abel Osundairo, who allegedly told Chicago police that Smollett paid them $3,500 by check to stage a hate crime against him in January, because he was upset with his salary on "Empire".

Smollett - who was not required to attend Tuesday's hearing - wore sunglasses and a gray coat as he arrived at the Leighton Criminal Courthouse, and remained silent when asked by reporters for comment.

The counts in the indictment obtained by CNN say Smollett gave statements to a Chicago police officer after the incident and to a detective.

"We welcome cameras in the courtroom so that the public and the media can see the actual evidence and what we believe is the lack of evidence against Mr. Smollett and we look forward to complete transparency and the truth coming out", she said.

Smollett's attorney, Mark Geragos, has questioned why the Osundairo brothers were not indicted alongside him.

Are you going to watch the Jussie Smollett arraignment live on Thursday? What is unexpected, however, is the prosecutorial overkill in charging 16 separate counts against Jussie.

In a statement to ET, Geragos said: "The fact of an indictment was not unexpected". The actor, who is free on bond, maintains his innocence. In the meantime, there is no warrant for his arrest in connection with this week's indictment "because it's the same case", Chicago police spokesman Anthony Guglielmi told Reuters. Allegations against Mr. Smollett are shameful & if proven, they are an affront to the people of Chicago who embraced him as a neighbor & respected him as a role model. After an investigation that lasted longer than three week, prosecutors charged Smollett with making a false report. "We love the hell outta you".

Smollett was arrested on February 21 after being charged with felony disorderly conduct for allegedly filing a false police report in which he claimed he was the victim of a hate crime.

On Friday, a Chicago grand jury hit the singer with 16 counts of disorderly conduct for fabricating the alleged January 29 attack during which he claims two masked white males beat him up and hurled racial and homophobic slurs at him and doused him with bleach. ". Empire actor Jussie Smollett took advantage of the pain and anger of racism to promote his career".

As previously reported, the check Smollett signed for the brothers was not for the attack, but, instead, for a training and nutrition program.
