Ashley Judd's sexual harassment lawsuit against Harvey Weinstein dismissed

Her sexual harassment lawsuit was re-filed following a change in California state law after her initial claim was rejected by Judge Gutierrez in a Los Angeles federal court last September.
Ms Judd claims that after she rejected Weinstein's sexual advances two decades ago, he defamed her to Lord Of The Rings director Peter Jackson, damaging her career.
She sued Harvey under the legal theory "sexual harassment in professional relationship". Unfortunately for Judd, the new law also says that it is not retroactive, so the judge said it does not apply to her case.
U.S. District Judge Philip S. Gutierrez said it was unclear if Judd's harassment claim fell under the definition of her lawsuit.
"The Court makes clear that it is not determining whether Plaintiff was sexually harassed in the colloquial sense of the term", he wrote in his decision.
Gutierrez previously said in September that the law upon which Judd's claim was based 'has never before been applied to an employer's sexual harassment of a prospective employee, and the court is not convinced that the statute was meant to cover such harassment'.
Despite "serious discussions to play a major role in the Lord of the Rings trilogy", court documents state, Judd wasn't cast in the film.
The rest of Judd's case, which includes claims of defamation, intentional interference with prospective economic advantage; and a violation of California's Unfair Competition Law, all for Weinstein's alleged badmouthing of Judd, which she claims significantly hurt her career.
Weinstein's lawyer, Phyllis Kupferstein, responded by saying they saw future wins against Judd, in a statement to CNN: "We have said from the beginning that this claim was unjustified, and we are pleased that the court saw it as we did".
Despite the setback, Judd's lawyer remains confident that the actress will prevail in her three remaining claims.
"Nothing about today's ruling changes that Ms. Judd's case is moving forward on multiple claims", Judd's attorney Ted Boutroussaid in a statement.
The disgraced producer - who denies the charges, which were brought by two women - will stand trial in NY later this year.
Jackson confirmed in December 2017 that Weinstein had in the 1990s sought to discredit actresses who later went on to accuse him of sexual misconduct.
The former movie mogul has denied engaging in non-consensual sexual activity.
