Audi has been fined €800m (£700m) for failings that enabled the firm to sell nearly five million diesel with software created to cheat emissions testing.

Volkswagen's subsidiary Audi agreed to pay an €800 million ($926 million) fine in Germany to settle a probe over the carmaker's role in the emissions cheating scandal that shook the auto industry three years ago.

VW was fined for developing and selling polluting four cylinder engines, while prosecutors in Munich at the time said they were examining whether to impose similar fines Audi.

Munich prosecutors have issued an administrative order against Audi for deviations from regulatory requirements in certain V6 and V8 diesel engines.

While the VW group has admitted 1.2 million vehicles were affected in the United Kingdom, it has refused similar payouts to owners on the grounds no European Union law was broken through the use of the software. Prosecutors also said Audi "failed to discover" that its vehicles sold with the VW Group's EA288 and EA189 diesel engines featured an impermissible software function to cheat emissions tests - unearthed in the Dieselgate scandal.

At Audi, former chief executive Rupert Stadler was removed from his post by VW earlier this month. The case covered some 4.9 million Audi cars sold in Europe, the US and elsewhere between 2004 and 20018. The investigation into Stadler and other executives is ongoing.

The penalty, which Audi accepted and won't appeal, consists of €5m (about R82m) for regulatory offenses, with the remainder a repayment of economic benefits as a result of the cheating, Audi said on Tuesday in a statement.

Prosecutors had jailed him in June, saying the move was necessary to stop him trying to influence witnesses.
