Just as video went public today of Harvey Weinstein seemingly sexual harassing a women in a business meeting, the attempts by the once high-powered producer to close down a criminal case that could see him behind bars for life was called out by the New York County District Attorney's office as "meritless" and that it "should be denied".

Per Thompson, she had set up a meeting with Weinstein in 2011, when she was 28, at his company's offices in NY, to pitch him on working with her on advertising and marketing initiatives for films.

The video only captures the two from the waist up but does show Thompson reacting with discomfort and telling Weinstein: "That's too high".

"Data's so hot", Thompson says later in the video. Weinsten then asks Thompson if he is "allowed to flirt" with her, to which she responds, "Um, we'll see".

"At first I tried to volley a little bit with him". Give it to me. "It's okay. Would you like to do it some more?" In the video, she noticeably squirms and says "that's a little high".

Throughout the meeting, Thompson is clearly trying to stick to her pitch even as Weinstein is running his hands on her arms. She recorded the encounter as part of the demo, which she told Sky she thought she was doing with the company's marketing team.

In a lawsuit filed in June, Thompson said Weinstein raped her that evening at a hotel.

"What they shared with us is that the video, when viewed in its entirety, in context and not in select excerpts, demonstrates that there is nothing forceful, but casual - if not awkward - flirting from both parties". Instead, she says she was asked to follow Weinstein upon arriving at the hotel to what she thought would be a conference room, but was actually his private hotel room.

"Anything short of that is meant to make Mr. Weinstein appear inappropriate and even exploitative", lawyer Ben Brafman said.


"A little bit", she tells him in the video.

Thompson's rape allegation is part of a class action lawsuit against the former Hollywood producer, whose career was toppled by a series of rape, sexual assault and harassment allegations previous year.

In the footage, Weinstein invites Thompson to join him at the Tribeca Grand Hotel lobby restaurant. "This is a further attempt to publicly disgrace Mr. Weinstein for financial gain, and we will not stand for it. Facts do matter", the lawyer told People magazine. "I had never met anyone that I couldn't handle, until Harvey Weinstein", she said.

"If he would make a comment, I would try to catch it and return it in a way that felt a little safer than the way he threw it at me".

"I think there was a combination of confidence and naivety that led me to this dynamic that we see now, watching back", she said.

Thompson, who had previously worked on Wall Street, rejected suggestions she encouraged Weinstein's behaviour.

Weinstein has been charged in NY with sexually assaulting three women. "We don't have to live with being raped when we think we're going to a business meeting", Thompson said.

Weinstein is due back in court in Manhattan Sept. 20.
