Prosecutors in the USA have said that Backstreet Boys singer Nick Carter will not face charges over an alleged sexual assault in 2003 because the statute of limitations for the alleged offence has expired.

The spokesman said the statute of limitations for the alleged offence expired in 2013.

Melissa Schuman accused Carter of raping her and waved her anonymity by writing a blog in February. The alleged incident occurred in 2003, with Schuman claiming that Carter raped her after she refused to perform oral sex on him.

The Associated Press generally doesn't name people who say they were sexually assaulted but Schuman has come forward publicly to speak about her experience and approves of the use of her name.

"Melissa never expressed to me while we were together or at any time since that anything we did was not consensual", Carter said in the statement.

The Dream singer went public with her claims past year and eventually filed a police report in Los Angeles in February, claiming Carter forced himself on her while they were hanging out at his home during a break from their movie The Hollow, when she was 18.

"An analysis of the strengths and weaknesses of the evidence is not warranted, and the matter is declined", prosecutors said in a charge evaluation worksheet released to the media.

After fans started responding with their condolences, Carter responded to one tweet, revealing that the couple - who have a 2-year-old son, Odin - had been expecting a little girl.

The Backstreet Boys singer has always maintained the sex was consensual, saying, "I am shocked and saddened by Ms. Schuman's accusations".

"It was just first trimester complications that passed, but I didn't completely connect with my baby until I got later into my second trimester, because I didn't know what was going to happen".

Carter has denied the allegation.

They said they did not otherwise evaluate the merits of Schuman's story. He is happy to put this matter behind him, ' the statement concluded.
