President Donald Trump has decided on his nominee to the Supreme Court after spending Monday morning working the phones primarily seeking input about two judges who were said to be the finalists, Brett M. Kavanaugh and Thomas M. Hardiman, people familiar with the discussions said.

Republican Sen. John Kennedy of Louisiana said he was bracing for a tough confirmation battle as Democrats focus on abortion.

Trump has not disclosed his top contenders to replace Justice Anthony Kennedy, who was a critical swing vote on the Supreme Court and late last month announced his decision to retire. Relishing the drama like the ex-game show host he is, Trump plans to reveal the pick in prime time from the White House's East Room.

"In a nation with over 700 sitting federal judges, many of whom were appointed by Republican presidents, it is outrageous that President Trump will nominate from a list of just 25 dictated to him by the Heritage Foundation", Casey complained.

President Trump campaigned with a promise to conservatives that he would fill the federal courts, from the top on down, with judges to their liking.

Trump last week spoke with seven candidates, all drawn from a shortlist compiled by the conservative Federalist Society, about the Supreme Court.


Kavanaugh, 53, on the U.S. Court of Appeals for the District of Columbia Circuit, is a favorite of the conservative legal establishment because of his long record on issues ranging from the separation of powers and executive privilege to abortion, immigration and gun rights.

His wife, Lori Zappala Hardiman, "comes from a family of prominent western Pennsylvania Democrats", a report from a local Philadelphia TV station noted. Barletta was elected to the U.S. House in 2010-a Republican "wave" year-and was also rumored to be on Trump's short list for labor secretary during the transition. The report also noted that the Supreme Court - which recently affirmed freedom of speech in saying pro-life crisis pregnancy centers can not be forced to promote abortion and freedom of religion in a decision on behalf of Masterpiece Cakeshop owner Jack Phillips in the same-sex marriage fight - now is earning its highest approval ratings in several years.

Trump is supposedly favoring Kavanaugh because of those views, per CNN.
