Nearly two-thirds of Americans believe that the landmark Roe v. Wade ruling should stand, according to a Gallup poll.

Support for Roe V. Wade is up substantially from 2012, when 53 percent of Americans said they did not want the Supreme Court to overturn the case.

"The President vowed to appoint judges to the Supreme Court who would overturn Roe v. Wade, and I can not support a nominee for a lifetime appointment who would turn back the clock on a woman's constitutional right and freedom to make her own health care choices, including access to birth control", Baldwin said in a statement.

Baldwin also opposed Justice Neil Gorsuch, Trump's first Supreme Court nominee. "If we put another two or perhaps three justices on, that will happen".

Trump announced his pick, Judge Brett Kavanaugh, Monday night.

In 2017, Kavanaugh wrote in a dissenting opinion that an undocumented teenager should not be allowed to seek an abortion while in custody at the US border in Texas. Although Kennedy was a swing vote on issues like abortion and same-sex marriage, he often was reliably conservative. Reproductive rights advocacy group Planned Parenthood is the latest to do so. "In light of President Trump's promise to appoint justices who would overturn Roe, this nomination could jeopardize the right to an abortion millions of women and families have relied on for more than four decades", the ACLU said in a statement.

The RNC plans to make Brett Kavanaugh's nomination the focus of phone calls and door-to-door visits with flyers and petitions, as well as Facebook and Twitter ad buys, email campaigns, volunteer training efforts and op-eds in key areas. Rob Portman, R-Ohio, on Capitol Hill in Washington, during a meeting Wednesday, July 11, 2018.

Karl asked Fallon if he and other Democrats are "entirely misstating" Kavanaugh's view of executive power, noting that in a 2009 Minnesota Law Review article, Kavanaugh explicitly said that Congress "might consider exempting a president" from criminal prosecution and investigations because there is "no constitutional protection".

While Baldwin's decision to vote against Kavanaugh isn't a surprise, her statement is noteworthy because she is the second Democrat up for re-election this year from a state President Donald Trump won in the 2016 election to come out against the Supreme Court nominee.

Any future similar fights before Kavanaugh could be meaningful.
